WHERE MAiD IS LEGAL IN THE U.S.

Fourteen U.S. jurisdictions have authorized medical aid in dying, if Montana is included. A few have passed laws that take effect later in the year.

  • Delaware (law passed; effective January 1, 2026)
  • District of Columbia
  • Hawaii
  • Illinois (law passed; effective September 12, 2026)
  • Maine
  • Montana (authorized via state Supreme Court ruling)
  • New Jersey
  • New Mexico
  • New York (law passed; effective August 5, 2026)
  • Oregon
  • Vermont
  • Washington

Note

Montana is the only jurisdiction where medical aid in dying is permitted through a state Supreme Court ruling rather than a statute. Because there is no statewide regulatory framework or reporting system, access varies and is not standardized throughout the state.
